Earn your stripes in the busiest harbor of North America, or lounge on deck and enjoy. US Coast Guard License: Yes, we’re a USCG licensed vessel for up to 6 passengers. USCG counts infants and children as passengers. Weather: With sailing you’ll feel the sun on your face, wind in your hair, and sometimes a rain shower. We monitor the weather closely. If conditions are unsafe, the Captain will reschedule your sail. Don't Miss the Boat! Due to a tight sailing schedule, the boat won’t wait if you arrive late. WEATHER POLICY Each sail is flexible in nature due to tides, winds and other weather conditions. Saga Sailing, LLC DBA Go Sailing NYC (GSNYC) will do their best to stick to the sailing schedule but cannot be held responsible for sails that end earlier or later than scheduled. There are no full or partial refunds for sails ending prior to the scheduled arrival time. GSNYC reserves the right to cancel any sail due to mechanical failure and/or adverse weather conditions. Adverse conditions include but are not limited to: excessive winds, thunder and lightning storms, small craft advisory, and other extreme conditions. Only the Captain can cancel a sail. Cancellations due to adverse weather conditions or mechanical failure will receive an email voucher valid for one year. Vouchers are subject to availability during the sailing season. No refunds will be issued. Rebooked sails are not able to be changed, cancelled or refunded. CANCELLATION POLICY I understand that if I do not arrive by five minutes past my scheduled departure no refund will be made available. If someone in my party is late or does not show up, there is no refund. Rescheduling is available up to 5 days prior to a booked sail, subject to availability. Within 5 days of a booked sail, no rescheduling or rebooking is available. All payments are non-refundable. TERMS & CONDITIONS With GSNYC, safety is the priority. GSNYC recommends that I wear a USCG approved Life Jacket. If I want to wear a Life Jacket one will be made available. Adults 18 years old and up have the sole responsibility to decide if they want to wear a Life Jacket. Passengers under the age of 18 must be accompanied by a parent or guardian. New York State law requires persons 13 years of age and under to wear a Life Jacket. Parents or guardians are responsible for determining if a minor ages 14-17 must wear a Life Jacket. USCG requires all infants and children, regardless of age, to be considered in the six person maximum. I understand there is no smoking onboard the vessel. The lavatory is onboard for our comfort. Boat toilets (heads) are notoriously easy to damage. I understand that I will not put anything down the toilet except 3 sheets of toilet paper. Privacy Policy and Personal Information: During reservation and registration, GSNYC may collect personal contact and/or transaction related information for GSNYC use only. GSNYC may also collect collect certain website usage data. GSNYC will not sell, share, or otherwise distribute this information to any third party without my consent and knowledge. I agree that any film or photographs of me/my child, as participants, become your property and may be used for promotional or commercial purposes. Gift Certificates are non-refundable. Gift Certificates are valid until the end of the following sailing season regardless of the time stamp on the certificate. For example if purchased May of 2019, the certificate is valid until October 31st of the 2020 sailing season. All gift certificates have a face value and may require additional payment if set prices are increased. ACKNOWLEDGMENT OF RISK There are significant elements of risk in any adventure, sport or activity associated with a working sailboat. By entering the premises of and/or accepting transit aboard a vessel owned or operated by GSNYC, I acknowledge that I am riding on a working sailboat that has inherent dangers associated with it and hereby exempts and releases GSNYC, their officers, members, agents, servants and employees from all liability and responsibility for personal injury, property damage or wrongful death however caused, including, but not limited to, product defect or the negligence of the released parties. I acknowledge that the following describes some, but not all of the risks one can face while aboard a vessel. 1) Slips, trips, falls or painful crashes while aboard the vessel and using the facilities; physical demands involving moving about the vessel. Risks to moving about the vessel on deck, below deck, or in the bathroom facilities: 2) Misuse of the equipment of facilities or failure of equipment: 3) Users (your) physical strength, coordination, sense of balance, and ability to follow or give directions while moving about the vessel: 4) Fatigue, chill and/or dizziness, which may diminish the users (your) reaction time and increase the risk or accident: 5) Injury from entanglement with ropes or equipment: 6) The presence, actions or falls of other participants. The user (I) understand(s) the descriptions of these risks is not complete and that other unknown or unanticipated risks may result in injury, illness, or death. The user (I) understand that the user (I) will use good judgement to be aware of my surroundings at all times. In addition, I agree to hold GSNYC harmless to possible injury, physically or mentally or even die. ASSUMPTION OF RISK & RESPONSIBILITY In recognition of the inherent risks of sailing which I and any minor children for which I am responsible, will engage in, I confirm that I am (we are) physically and mentally capable of participating in the activity and/or using equipment. I/We participate willingly and voluntarily and I assume full responsibility for personal injury, accidents and illness (including death), and any related expenses. I also assume responsibility for damage to or loss of my/our personal property. I recognize that GSNYC, as a provider of services, will operate under a covenant of good faith and fair dealing, but that you may find it necessary to refuse or terminate, passengers you judge to be incapable of meeting the rigors or requirements as a passenger. I (my minor) accept your right to take such actions for the safety of myself and/or other passengers. I hereby authorize any medical treatment deemed necessary in the event of any injury or illness while participating in this activity. I either have the appropriate insurance or, in its absence, agree to pay all costs of rescue and/or medical services as may be incurred on my/our behalf. RELEASE OF LIABILITY Any claim of damage shall be governed by Federal Maritime law. In any action against GSNYC, or its officers, members, agents, partners, employees, or servants which results in a judgment, decree, order, stipulation or settlement substantially upholding GSNYC’s position, the adversarial party shall reimburse GSNYC attorney’s fees, court costs and expenses. I have read and understood the foregoing acknowledgment of risk, assumption of risk and responsibility, and release of liability. I understand that by signing this form I may be waiving valuable legal rights. Also, I acknowledge that I have been given a copy of this document.
